Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Fillyr (“Fillyr”, “we”, “us”, or “our”) and govern your access to and use of the Fillyr website, applications, and services (together, the “Service”). Please read them carefully. By creating an account or otherwise using the Service, you agree to these Terms; if you do not agree, do not use the Service.

1. The Service

Fillyr lets you turn a flyer image into a fillable template: you map text and image fields onto your design, publish a shareable link or QR code, and let recipients personalise the flyer and download their own version. We also provide tools to generate flyers in bulk from a spreadsheet, manage your flyers, and view basic analytics about how your links are used.

We may add, change, or remove features at any time, and we may impose or adjust limits on the Service (for example, the number of flyers per account) at our discretion.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use the Service. If you use Fillyr on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and “you” refers to that organisation.

3. Your account

You are responsible for the information you provide when registering and for keeping it accurate. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorised use of your account.

You may sign in using a supported third-party provider (such as Google). Your use of that provider remains subject to that provider’s own terms.

4. Your content

“Your Content” means the flyer images, field configurations, sample values, titles, and any other material you upload to or create with the Service. As between you and us, you retain all ownership rights in Your Content.

You grant Fillyr a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, publish, and display Your Content solely as needed to operate, provide, secure, and improve the Service — including generating shareable fill links, rendering previews, and producing the downloadable flyers your recipients create. This licence ends when you delete Your Content or close your account, except for residual copies retained in routine backups for a limited period or as required by law.

You represent and warrant that:

  • you own Your Content or have all rights and permissions necessary to upload it and grant the licence above;
  • Your Content, and our use of it as permitted here, does not infringe or violate the rights of any third party or any applicable law; and
  • any images, fonts, logos, or trademarks in your flyers are used with the necessary rights.

5. Recipient submissions and personal data

When you publish a flyer, people who open your link (“Recipients”) may enter their own information into the fields you created, such as a name or a photo, to generate a personalised flyer. Photos chosen on the fill page are processed in the Recipient’s own browser and are not uploaded to our servers.

If you collect personal information from Recipients, you are the party responsible for that information. You agree to:

  • only request information that is appropriate and lawful for your purpose;
  • provide Recipients with any notices and obtain any consents required by applicable privacy and data-protection laws; and
  • not use the Service to collect information deceptively or to send unsolicited communications.

6. Acceptable use

You agree not to use the Service to:

  • upload or share content that is unlawful, infringing, defamatory, obscene, hateful, or that depicts or exploits minors;
  • impersonate any person or organisation, or misrepresent your affiliation;
  • distribute malware, run a phishing or fraud scheme, or collect data under false pretences;
  • probe, scan, overload, disrupt, or attempt to gain unauthorised access to the Service, our infrastructure, or other users’ accounts;
  • reverse-engineer, scrape, or build a competing product from the Service except to the extent this restriction is prohibited by law; or
  • infringe any law or the rights of any third party.

We may remove content or suspend access that we reasonably believe violates these Terms.

7. Intellectual property

The Service, including its software, design, branding, and the “Fillyr” name and logo, is owned by Fillyr and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for your own internal or personal purposes. We reserve all rights not expressly granted.

8. Third-party services

The Service relies on third-party providers for functions such as image hosting, authentication, and email delivery. Your use of the Service may be subject to those providers’ terms, and we are not responsible for third-party services or for content or sites we link to.

9. Fees

We may offer the Service free of charge or under paid plans. If we introduce paid features, the applicable pricing and payment terms will be presented to you before you incur any charge, and your continued use of a paid feature constitutes acceptance of those terms.

10. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Service you acknowledge that Privacy Policy.

11. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use poses a risk to the Service or others, or as required by law. On termination, your right to use the Service ends and we may delete Your Content, subject to applicable law and our backup practices. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Fillyr disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content will be preserved without loss.

13. Limitation of liability

To the fullest extent permitted by law, Fillyr and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Fillyr from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms with a new “Last updated” date or notifying you in the Service. Changes take effect when posted, and your continued use of the Service after that means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the jurisdiction in which Fillyr is established, without regard to its conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, unless mandatory local law in your country of residence provides otherwise.
